Elmbridge Council will be back in court after a group of travellers set up an unauthorised site outside Bell Farm School.
A gypsy/traveller liaison officer has visited the site on the wide grass verge owned by the council.
The council is now progressing papers in order to apply for repossession of the land and a court hearing date will be set.
A refuse bin has been given to the group and a council grounds maintenance contractor clears litter when possible.
The site will be cleared when it is repossessed by the council.
