An 18-year-old charged with a burglary offence during the Battersea riots has said he is "appalled" his mother is being threatened with eviction as a result.

Daniel Sartain-Clarke, now of Kensington Gardens, Bath, denies burglary with intent to steal at Currys, in St John's Road on August 8.

Wandsworth Council responded to the charge made against him by serving his mother, 43-year-old Maite de Calva, with an eviction notice from the family's council-owned home.

In an interview with the BBC, Ms de Calva claimed the council was using her family as "scapegoats" and said the authority was behaving in a "dictatorship-like" fashion.

She added: "According to me, they are fascists."

Mr Sartain-Clarke said: "I'm appalled by that fact they are putting her in this position because of me as she has nothing to do with it. These are the consequences of my actions that I am dealing with and not hers."

The council has said it will only pursue the eviction if he is found guilty.

A council spokesman said: "It is made very clear to all tenants when they are given the keys to a taxpayer-subsidised home that all the members of their household must abide by certain rules.

"Taking part in violent acts like rioting, looting, trashing local businesses and being part of a mob that burns innocent people out of their homes, is in our view very clearly breaching those rules."

However, its stance has provoked a fierce reaction from critics. Campaign group the Social Justice Collective has already staged a protest outside the home of council leader, Councillor Ravi Govindia.

And campaigners gathered outside South Western Magistrates Court on Tuesday, when Mr Sartain-Clarke was finally granted bail, having been in custody since his arrest on the night of the riots.

He was granted bail providing he abide by several conditions including a 7am to 7pm curfew and that he not enter the M25 area except to attend court.

Mr Sartain-Clarke will next appear at Inner London Crown Court on October 4.
