A perverted pensioner who exposed himself to his neighbours while performing early morning sex acts has avoided jail.

Married Peter Marshall, 72, would masturbate naked by the window of his ground floor living room, after illuminating himself by switching on a lamp.

The convicted sex offender would lift up the window’s lace curtains to under his chin to expose himself to shocked neighbours in Buckhurst Avenue, Carshalton, Croydon Magistrates’ Court was told.

The serial flasher was spotted on three occasions by a neighbour, always performing the solo sex act at about 7.15am, the court heard.

His depraved actions, lasting up to four minutes, were also witnessed by the woman’s daughters, aged 18 and 25.

He flashed the women during January last year, before he was reported to police.

The sex acts broke the terms of a sexual offence prevention order (Sopo) given to Marshall in 2007 for similar acts of exposing himself to the public.

At Croydon Magistrates’ Court on Monday, July 11, Marshall, who now lives with his wife in a retirement flat in Briar Wood, Banstead High Street, was given a curfew order, which means he will be electronically tagged for four months.

He was told it was only because he was elderly he had avoided jail.

He had previously pleaded guilty to three counts of indecent exposure and three breaches of a Sopo.

District judge Robert Hunter told him: “I have read a considerable amount about you. As a repeat offender, were you younger and were you not in such a frail state I would be imposing a prison sentence.”

He said as an act of mercy, and the fact custody would likely negatively affect Marshall’s health, he would impose the curfew order, where Marshall would have to remain at home between 7.30pm and 6am each day.

He warned him if he reoffended or broke the order he would face a prison sentence.

Marshall, representing himself, said he did not go out at night anyway.
