An alcoholic who breached a restraining order prohibiting him from making contact with his 89-year-old mother, after he beat her, has been jailed for six months.

Kingston Magistrates’ Court imposed the restraining order on Stewart Healey, 46, on December 10, 2009.

But police discovered he was still living with his mother Mary when they carried out a welfare check at her home in New Malden.

His mother told police that she did not want him there, but did not want to see him living on the street, and admitted he had been staying there for months.

Prosecutor Liz West said: “She feels it’s her duty to let him live there in order to protect her from living on the streets but she’s extremely vulnerable. Her health is poor and she’s told police she doesn’t want him living at the address.”

Healey was in court a couple of days before his sentencing, on June 10, for breaching a community order, but his address was mistakenly given as his mother’s as part of his bail conditions.

Lead magistrate Mr Salem said: “This offence is so serious that only custody is appropriate and we are going to send you to prison for a total for six months.

“The aggravating factors are that your mother is an extremely vulnerable person, 89 years of age and you failed to comply with previous court orders.”

Healey was ordered to serve half of the six month sentence.
