A teenager and a man have been jailed for a “brutal” and “unprovoked” attack on a father-of-two they believed was a paedophile and who was left severely brain-damaged.

A second teenager, who helped them attack Portuguese national Filipe Nunes David, 40, in Cox Lane, West Ewell, on August 18 last year, as he cycled home, was given a supervision order at Kingston Crown Court today (April 19).

Mr David suffered severe head injuries after Brett Carslake, 20, Jamie Bailey and Frank Miller, both 17, set upon him shouting “come on, let’s get him” as he cycled past.

Carslake, 20, from Epsom, has been given an indeterminate sentence and will serve a minimum of five years in jail for hitting Mr David once in the head with a plank of wood.

Bailey was sentenced to five years, of which he will serve at least two-and-a-half in jail, also for beating Mr David once in the head with a plank of wood.

Both had pleaded guilty to grievous bodily harm with intent on separate previous occasions.

Miller, who did not beat Mr David, was given a 24-month supervision order and curfew after he cycled into the father-of-two’s bike, preventing him from fleeing.

He had pleaded guilty on February 15 to grievous bodily harm without intent.

Bailey and Miller can now be named because the Epsom Guardian successfully applied to lift a court order granting them anonymity.

The three men had been chatting with friends near the bus stop in Hogsmill Way, West Ewell.

Prosecutor Richard Jory QC said Carslake had been drinking beforehand and Bailey and Miller admitted using drugs.

Mr David went to meet his partner Helena Sousa and two children in Cox Lane. They failed to show up and he went to buy a drink from a shop in Ruxley Lane.

He cycled past the group on his way and bought a can of lager. On his way back, they saw him and set upon him.

Miller ran his bike into Mr David’s bike, stopping him, and allowing Bailey to take the first swing with half a plank of wood Carslake had taken from a nearby tree's support.

According to witnesses, Mr David screamed “why me?” and “what for?”

Carslake, who had the other half of the plank, took the next swing over his shoulders, holding it with both hands, leaving Mr David on the ground bleeding profusely from head, nose and mouth.

They then left celebrating and chanting “we have beaten the paedophile”, the court heard.

Bailey returned to where Mr David was and took a pack of cigarettes from his shirt pocket.

Mr Jory said: “After the attack the three defendants ran off, but Jamie Bailey went off to Mr David and took his cigarettes from his shirt pocket, and said ‘safe’ which is street slang for ‘thanks’.”

A couple who drove past Mr David after the attack went to his rescue and an ambulance arrived shortly afterwards.

Mr David, who was in a coma for two weeks after the attack, had to undergo a craniotomy, had part of his skull and brain tissue removed on the left side and is currently rehabilitating at Epsom Hospital.

Recorder Simon Oliver said: “This was a brutal and unprovoked attack on Mr David on August 18, 2009, when he was cycling along a road in West Ewell.

“The three of you then approached him and attacked him and involved yourselves in gratuitous and extreme violence.

“We know this because Mr David is in this court today. The attack was so serious and the injuries he sustained so severe that he was unable to give a statement in this case. I hope that his appearance leaves you with a very sick feeling in your stomach.

“Mr David had done nothing whatsoever. There was some suggestion that he was a paedophile – it was never a suggestion that was confirmed – and for you to even consider to take any action into your own hands because of this suggestion is appalling.”
