Judges have quashed the conviction of a man found guilty of killing Weybridge taxi driver Preston Trueick, in a crash on the A3 in 2008.
Deane Girdler, a 44-year-old construction manager from Woodham, was found guilty by a jury at Kingston Crown Court in July of causing death by dangerous driving.
But on Tuesday, November 24, three judges at the Criminal Appeal Court in London decided the verdict was unsafe.
He will now face a retrial over the death of Mr Trueick, 61, and 67-year-old Catherine Cunningham, from Liphook, Hampshire, who also died during the crash in January 2008.
The jury at Kingston Crown Court in July could not come to a decision on whether he was guilty of causing Ms Cunningham’s death.
The retrial on both counts will take place in February next year.
Mr Girdler, who had been in custody waiting to be sentenced, has now been released on bail.
