LONDON BOROUGH OF SUTTON ANTI-SOCIAL BEHAVIOUR, CRIME AND POLICING ACT 2014 PUBLIC SPACES PROTECTION ORDERS

TAKE NOTICE THAT in its continuing efforts to combat instances of Anti-Social Behaviour associated with the consumption of alcohol and Nuisance, the London Borough of Sutton (The Council) in partnership with the Metropolitan Police and Safer Sutton Partnership service, are hereby giving notice that the existing Designated Public Places Orders within the borough, will on 21st October 2017 convert to Public Spaces Protection Orders.

The purpose of the Public Spaces Protection Orders is make the public spaces within Sutton more welcoming to the public and to stop individuals or groups from committing or engaging in anti-social Behaviour within the public spaces within the borough. This Behaviour has a detrimental effect on the quality of life of those within the locality. The Council and the Metropolitan Police are of the opinion that given the continuing nature of the anti-social Behaviour, it would be unreasonable not to address the detrimental impact on those within the locality.

Within the areas set out in Appendix A, the consumption of alcohol is not prohibited, however in circumstances where a constable suspects that a person is engaging in Anti-Social Behaviour, the Public Spaces Protection Order will allow a constable and other accredited persons under Section 41 and Section 42 of the Police Reform Act 2002 to require a person, not to drink alcohol in that place, if the officer reasonably believes that a person has consumed or intends to do so, and to surrender the alcohol and any opened or sealed containers in the person's possession. Any person who fails to comply with a constables request under this provision may commit an offence and be liable to prosecution.

The Public Spaces Protection Order will last for a period of three years and will be subject to review.
