An unsuccessful Labour election candidate is one step closer to forcing a by-election in Waddon after residents missed out on the their right to vote on May 6.
Today, a high court judge ruled an Election Commissioner should be appointed to oversee a five day hearing in Croydon to investigate the claims.
David Christison issued the election petition to Jon Rouse, the Chief Returning Officer, when an estimated 80 voters could not cast their votes because of long queues in some of the wards.
Mr Christison was one of the three Labour council hopefuls who stood for election in Waddon, historically one of the most marginal wards in the borough.
In the May 6 election, the incumbent Conservative candidates held onto their seats.
Mr Christison polled 500 fewer votes than his nearest Conservative rival.
The elected councillors are: Tony Harris 2,656 votes, Clare Hilley 2,627 votes, Simon James Hoar 2,423 votes.
