A whistleblowing heart doctor is still battling the hospital which he believes unfairly dismissed him for raising concerns about care.

Professor Mike Chester, a member of Kingston’s clinical commissioning group, was sacked on September 23, 2011, by Royal Liverpool and Broadgreen hospital trust (RLBUHT) after raising concerns about patients undergoing angina surgery.

The trust denies targeting him because of his concerns and said it sacked him for a number of acts of “gross misconduct'.

He has written of how he became a “broken record” on the subject, saying on the medicalharm.org blog that he was “endlessly nagging about unnecessary procedures and their potentially disastrous consequences but no one was listening.”

An employment appeal tribunal hearing will take place in October after RLBUHT, which did not respond to the previous proceedings in a timely manner, appealed a default decision of unfair dismissal.

Prof Chester said: “The matter was settled as far as I was concerned. The judgement was in my favour on all counts.

“They appealed that decision and we are appealing their right to appeal that decision.

“We feel we have got a fairly strong case and we will have to see what happens.

“The NHS treats whistleblowers very badly. That is the history of the NHS, that is my history."
